Part I · Overview

New Mexico State Income Tax Overview

New Mexico uses a graduated income tax with six brackets from 1.5% to 5.9% for single filers, reaching the top rate above $210,000. H.B. 252, enacted in March 2024, restructured the lower brackets: it added a new 4.3% bracket covering $16,500 to $33,500 for single filers and widened the 4.7% and 4.9% bands, leaving the 5.9% top rate unchanged. New Mexico uses the federal standard deduction, $15,000 for single filers and $30,000 for joint filers, and offers a $4,000 deduction for dependents in lieu of the suspended personal exemption. Social Security benefits are exempt for most filers below income thresholds, and New Mexico levies a gross receipts tax rather than a conventional sales tax.

Part I-B · New Mexico Rules

What Is Different About New Mexico's Income Tax

Deductions and exemptions

New Mexico uses the federal standard deduction and follows federal itemized deductions with state tax paid removed. The state added a deduction for federal itemizers and a low- and middle-income exemption that phases out as income rises. New Mexico restructured its brackets for 2025 to lower rates on the first $50,000 of income.

Credits worth knowing

The working families tax credit is 25% of the federal earned income credit, and the child income tax credit pays $25 to $600 per child depending on income. A low-income comprehensive tax rebate offsets gross receipts tax for households under an income limit, and there is a credit for taxes paid to other states.

Retirement, capital gains, and other income

Social Security is exempt for single filers with income under $100,000 and joint filers under $150,000. Taxpayers 65 and older may claim a deduction of up to $8,000 for retirement and other income that phases out with income, and military retirement pay is exempt up to $30,000. New Mexico excludes 40% of net capital gains or $1,000, whichever is greater.

Beyond that, New Mexico-specific credits and deductions that don't exist at the federal level are listed at the New Mexico Taxation and Revenue Department -- worth checking, since these are easy to miss if you only look at federal guidance.
